Section 376 covers specified articles, animals, trades and operations, including an activity that the Municipal Commissioner considers dangerous to life, health or property or likely to create a nuisance.

This premises-and-activity approval is not a blanket registration for every commercial establishment in Maharashtra.

2. Maharashtra Shops and Establishments registration or intimation

This is an employment-conditions registration under the Maharashtra Shops and Establishments (Regulation of Employment and Conditions of Service) Act, 2017. It applies across Maharashtra, including establishments in KDMC limits, but the worker-count route differs:

Section 2 defines an "establishment" broadly. It includes shops, offices, godowns, warehouses, restaurants, hotels, professional practices and other businesses, but excludes a factory covered by the Factories Act, 1948. Section 3 also contains specific exclusions, so do not decide applicability from the word "shop" alone.

3. Sector and premises approvals

A municipal licence and Shops Act record do not replace an FSSAI licence, fire approval, pollution-control consent, Legal Metrology registration or factory approval where applicable.

How to check if a KDMC shop licence applies to your activity

Section 376(1) of the Maharashtra Municipal Corporations Act, 1949 does not say that every shop automatically needs the same municipal licence. It controls activities and stored articles specified in municipal rules, certain commercial keeping of animals, listed trades, and trades or operations considered dangerous or likely to cause nuisance.

Run this four-part check:

  1. Confirm the premises is inside KDMC limits. The licence is tied to the municipal jurisdiction and stated premises. A licence from another municipal corporation does not authorise an activity in Kalyan-Dombivli.
  2. Describe the real activity, not merely the entity type. "Private limited company" tells KDMC nothing about whether the premises stores chemicals, prepares food, runs machinery or only provides office services.

  1. Access the applicant account. Use contact details controlled by the business.
  2. Choose the new business licence service. Do not select renewal merely because the premises had a licence under a previous occupant.
  3. Enter the premises and property details. Copy identifiers from KDMC records where available.
  4. Select the activity class carefully. Include every material, process or service affecting scope.
  5. Upload the documents requested for that category. Keep filenames readable and scans complete.
  6. Review and submit. Download the complete submitted form.

If the portal is unavailable, the Directorate of Municipal Administration says applicants may use the local municipal office. Keep the acknowledgement; a verbal assurance is not approval.

Once granted, Section 376(6) requires the licence to be kept in or on the premises to which it relates. Section 376(7) permits inspection of licensed premises. Keep a printed copy accessible and the digital original in a shared compliance folder.

Renew, amend or transfer before the certificate becomes misleading

Section 386(1) of the Maharashtra Municipal Corporations Act, 1949 requires the licence to state its validity period, conditions and the date by which a renewal application must be made. That printed date - not an assumption that every licence expires on 31 March - is your deadline.

Section 386(4) creates a narrow protection: when a renewal application is made by the date specified on the licence, the applicant may act as if it has been renewed while awaiting the order. If the licence expires without a timely renewal application, the holder is treated as operating without a licence until renewal.

Use this operating calendar:

Do not renew unchanged when facts changed. Section 386(3) permits suspension or revocation for misrepresentation, fraud, breached conditions or a related conviction. Use the correct KDMC amendment, category-change, transfer or cancellation service.

Track both the printed legal deadline and an earlier internal deadline.

Do not miss the separate Maharashtra Shops Act deadlines

The municipal certificate does not satisfy the employment-law calendar.

For establishments with 10 or more workers, Section 6 of the Maharashtra Shops and Establishments Act requires registration within 60 days of starting business. The certificate can be requested for a period up to 10 years. Renewal must be submitted at least 30 days before expiry. If submitted after expiry but within 30 days, Section 6(4) requires a late fee equal to half the normal renewal fee.

For establishments with fewer than 10 workers, Section 7 requires intimation within 60 days. Contravention of Section 7 carries a ₹1,000 penalty under the text amended by Maharashtra Act 56 of 2025.

Other continuing duties include:

Section 29 now permits a general penalty up to ₹1 lakh and up to ₹2,000 per continuing day, subject to a total cap of ₹2,000 per worker. A second or later contravention can attract up to ₹2 lakh, with the same per-worker cap. These are statutory maximums, not automatic amounts for every case.

Maharashtra's Labour Department states a one-day Right to Services time limit for registration and amendment once a proper application reaches the Facilitator. The business still has its 60-day filing deadline.
