In Maharashtra, a general contravention of the Maharashtra Shops and Establishments (Regulation of Employment and Conditions of Service) Act, 2017 can attract a fine up to ₹1 lakh, plus up to ₹2,000 for every continuing day, subject to the Act's per-worker cap. The expensive mistake is usually not refusing to register; it is assuming that one national process, employee threshold or certificate works everywhere in India.

This guide explains how to identify the correct state law, find the official online service, prepare a clean evidence pack and verify the certificate after issue. The examples use official material available on 12 September 2026. Recheck your state's Labour Department portal before filing because forms and portal routes change.

Why the correct state process prevents a failed registration

There is no single central “Shop and Establishment Act” or all-India Shop Act licence. The registration comes from the law applicable where the establishment is located. Maharashtra uses the Maharashtra Shops and Establishments (Regulation of Employment and Conditions of Service) Act, 2017. Delhi uses the Delhi Shops and Establishments Act, 1954. Telangana uses the Telangana Shops and Establishments Act, 1988. Karnataka uses the Karnataka Shops and Commercial Establishments Act, 1961.

That distinction changes five practical questions:

  1. whether the premises and activity are covered;
  2. whether registration, intimation or neither is currently required;
  3. whether an employee-count threshold changes the filing;
  4. which form, documents, fee and portal apply; and
  5. whether the certificate expires, needs renewal or only needs event-based updates.

The document is generally called a registration certificate, although owners often search for “licence”, “Shop Act licence” or “Gumasta licence”. It is not the same as a municipal trade licence, GST registration, Udyam registration, FSSAI licence, fire approval or factory licence.

A company also files by establishment, not merely by legal entity. Premises in Mumbai, Hyderabad and Bengaluru must each be tested under the relevant state law and portal.

Start with applicability, not the portal login

Record the following before creating an account:

The last two items matter. Maharashtra's 2017 Act defines a shop broadly to include an office, store-room, godown, warehouse or workplace connected with trade or business, but excludes a factory. Section 3 also lists excluded establishments and persons. A generic list saying “every office must register” is therefore not a legal applicability test.

How to find the official shop & establishment license online portal

Use an official route and save evidence of how you reached it.

Use this order:

  1. Open the state Labour Department website on a gov.in, nic.in or official state domain.
  2. Locate “services”, “online services”, “Shops and Establishments” or the state single-window page.
  3. Confirm that the service names the same Act and filing type you identified.
  4. Read the latest notification, rules, service timeline and document list linked by the department.
  5. Save the official page URL and access date in your compliance record.

Check the domain, HTTPS certificate and department contact details. Do not send Aadhaar, PAN, a digital signature or portal credentials to an unverified agent.

Maharashtra: Section 6 registration or Section 7 intimation

Under Section 1(3) of the Maharashtra Shops and Establishments Act, 2017, most provisions apply to establishments employing ten or more workers, while Section 7 applies to establishments employing fewer than ten.

Section 6(1) requires an employer with ten or more workers to apply online within 60 days after the establishment commences business. The application goes to the Facilitator for the local area and contains the employer or manager name, postal address, establishment name and actual nature of business. Section 6(2) provides for an online registration certificate and Labour Identification Number. Section 6(3) permits validity requested by the applicant up to ten years.

For fewer than ten workers, the Maharashtra Shops and Establishments Rules, 2018 use online Form F for commencement intimation, followed by a Form G receipt. Employers with ten or more use Form A. Rule 4 says no statutory fee is prescribed, although electronic transaction or service charges may apply. The current Maharashtra Labour Department service timeline lists one day for registration; the 2018 Rules state that a complete Form A certificate is to be digitally signed within seven working days. Treat the shorter service commitment as an administrative target, not permission to miss the statutory 60-day filing period.

There is a warning worth understanding. A current BMC Shops and Establishments page displays Form A for 20 or more employees and Form F for 0–19, while the state Act and Rules say ten or more versus fewer than ten. Do not silently choose whichever threshold is convenient. Capture both official sources and ask the local Facilitator or BMC for written confirmation of the filing route applicable on the day. The governing statute and valid amendments control; a portal label can lag or reflect a local workflow that needs explanation.

Maharashtra Section 29 provides the general penalty: up to ₹1 lakh for a contravention, plus up to ₹2,000 for each continuing day, with the total subject to ₹2,000 per worker. A repeat conviction for the same provision can reach ₹2 lakh, again subject to the stated per-worker cap. These are statutory maximums, not a standard invoice automatically charged for every late application.

Delhi: read the current administrative position

Section 5 of the Delhi Shops and Establishments Act, 1954 contains a registration mechanism. Yet the Delhi Labour Department's current Act page says the registration requirement has been kept in abeyance since 1989. Its inspectorate material repeats that position. At the same time, an official online-registration FAQ describes a free, real-time certificate service.

That is precisely why old “all states” tables fail. For a Delhi premises, retain the current Labour Department statement, check the live service, and obtain department confirmation if a bank, tender authority or adviser insists on a certificate. Do not pay a private site for a fabricated annual renewal. Registration being in abeyance also does not erase the Act's working-condition and record obligations that remain applicable.

Telangana: account for 2025 and 2026 notifications

The Telangana position changed recently. The official TS-iPASS Acts and Rules page lists G.O. Rt. No. 383 dated 23 September 2025 concerning an exemption for establishments employing up to ten employees. It also lists G.O. Ms. No. 8 dated 23 June 2026 for self-registration on an intimation basis under the Telangana Shops and Establishments Act, 1988.

Use the notification in force for your worker count and application date rather than a 2024 blog. Telangana's official state-services page links an online “Application for Registration of Shops and Establishment”, and the Ministry of Labour's Telangana integration page lists registration under the Act. Save the filed intimation, acknowledgement and generated certificate or receipt; “self-registration” still needs evidence.

Exact documents differ by state, entity, premises and activity. Prepare a master pack, then upload only what the official form requests.

The Maharashtra 2018 Rules illustrate the level of detail. Form A asks for the organisation type, partner or director information, incorporation or registration proof, manager details and separate counts for workers, apprentices, contract labour and part-time workers. A single payroll headcount pasted into every field is not reliable.

Match names and addresses character for character. If the lease says “Unit 402” and the incorporation record says “Office 4B”, resolve or explain the mismatch before filing. Use readable PDFs, keep file names clear and check that every scan includes all pages. Most objections are boring data defects, not deep legal disputes.

Complete the online application without losing evidence

Treat the filing like a controlled business process:

  1. Choose the filing type. Separate new registration, commencement intimation, amendment, renewal and closure. The wrong transaction can produce a useless acknowledgement.
  2. Create the employer profile. Use a controlled company email and phone number, not an agent's personal account.
  3. Enter premises data. Use the address and commencement date supported by your documents.
  4. Classify the activity. Describe what actually happens at the location. Do not select a convenient category solely to reduce fees or scrutiny.
  5. Enter the worker count. Apply the definition and bands used by that state's form and current notification.
  6. Upload and review. Compare the preview against the evidence pack before submitting.
  7. Pay only through the official gateway. Save the challan, transaction reference and bank confirmation.
  8. Download the acknowledgement. Record the application number, filing date, service timeline and responsible owner.
  9. Answer objections promptly. Preserve every query, response and revised document.
  10. Verify the output. Check legal name, premises, activity, worker count, registration number, issue date and validity.

A screenshot of the payment page is not the final compliance evidence. Keep the submitted form, uploaded document set, payment record, acknowledgement, correspondence and digitally issued certificate or intimation receipt together.

After issue, convert the certificate into operational controls. Maharashtra Section 9 requires changes in certificate particulars to be notified within 30 days of the change. The 2018 Rules use online Form I. Section 6(3) requires renewal at least 30 days before expiry where a registered establishment has a time-limited certificate. Track address, ownership, manager, activity and worker-count changes instead of waiting for an annual reminder.
