There is no central Shop and Establishment Act for all of India. Each state or union territory sets its own applicability threshold, registration period, form, portal, fee and renewal rule. The correct renewal date therefore comes from four pieces of evidence:

  1. the law and rules applicable to the state where the premises is located;
  2. the expiry date printed on the current certificate;
  3. the current service shown on the official Labour Department or state single-window portal; and

Do not copy the anniversary date from another branch. A Mumbai office and a Jaipur office may belong to the same company but sit under different state laws. Also confirm the document is really a Shop Act certificate: “Gumasta”, municipal trade licence, Certificate of Enlistment and Shops registration are often mixed together, but renewing one does not renew the others.

Maharashtra: renew 30 days before expiry, not every year

The Maharashtra Shops and Establishments Act, 2017 is unusually specific.

Section 6 applies to establishments employing ten or more workers. Section 6(1) requires registration within 60 days of commencement. Section 6(3) lets the applicant choose the certificate period, subject to a maximum of ten years. It requires the online renewal application not less than 30 days before expiry.

If the application is filed after that advance window but within 30 days after expiry, Section 6(4) provides for an additional late fee equal to half of the renewal fee.

The Maharashtra Shops and Establishments Rules, 2018 add the operational detail:

For establishments with fewer than ten workers, Section 7 uses an online intimation model rather than the Section 6 registration model. If the workforce reaches ten, the establishment must obtain Section 6 registration. That employee threshold is a compliance trigger, not just an HR statistic.

Maharashtra’s general penalty provision in Section 29 allows a fine up to ₹1 lakh for contravention, plus up to ₹2,000 for each continuing day, subject to the stated per-worker cap. This is a general maximum, not an automatic late-renewal invoice. The actual enforcement outcome depends on the contravention and proceedings.

Delhi: the statute and current administration must be read together

The text of the Delhi Shops and Establishments Act, 1954 contains registration provisions, and the older rules contain a renewal mechanism. Reading only that text can send a business down the wrong path.

The Delhi Labour Department’s current Act page explicitly says the registration requirement has been kept in abeyance since 1989. Its online-services page describes Shop and Establishment registration as a free, real-time service, but does not list an annual Shops certificate renewal service.

The sensible response to a Delhi “renewal due” email is:

  1. verify whether it refers to Shops registration or another approval;
  2. compare the demand with the Labour Department’s current page; and
  3. ask the issuing authority for the supporting notification or rule and retain its response.

Do not rely on an agent’s generic reminder. Delhi’s law still regulates working conditions even where the department says registration is in abeyance. “No renewal filing” does not mean “no labour compliance.”

Rajasthan: distinguish lifetime certificates from legacy renewals

Rajasthan’s current Shops and Commercial Establishments fee page lists lifetime registration fees by employee band: ₹5,000 for 0–10 employees, ₹20,000 for 11–50, ₹50,000 for 51–100 and ₹1,50,000 for 101 or more. Because it says lifetime, a newly issued certificate under that structure should not be placed on an annual-renewal calendar.

But the state’s Labour Department Management System still documents a renewal route. The official registration and renewal procedure instructs applicants to select Establishment Renewal, retrieve the registration record, enter the expiry year and employee count, upload the certificate and Form V, and pay online. The department’s disposal timeline identifies Form 5 and says renewal under Rule 6(2) of the Rajasthan Shops and Commercial Establishments Rules, 1959 has deemed approval or a maximum 15-day timeline.

The portal may need to service older certificates issued for a limited period while new registrations are lifetime. If your certificate states an expiry date, renew through LDMS; if it is lifetime, monitor amendments and report changes instead.

The Rajasthan fee page also states that a 100% renewal penalty applies after 30 days from the due renewal date. That makes early classification important: first decide whether the certificate expires, then act on the correct date.

How to renew without application defects

Once renewal is confirmed, work backwards from the state deadline. A “submitted” screenshot is not enough; retain the accepted application, payment evidence and renewed certificate.

Build one clean evidence pack

The exact checklist varies, but most renewal workflows draw from the same records:

Match names and addresses character for character. If the lease says “Unit 402” and the old certificate says “Office 4B”, resolve the discrepancy rather than uploading both and hoping the officer guesses. If the entity, employer, address or workforce band has changed, use the amendment process required by the state; a plain renewal may not correct the record.

Follow a controlled filing sequence

  1. Enter the official state Labour Department or single-window portal directly, avoiding sponsored lookalike sites.
  2. Retrieve the establishment and confirm its legal name, address and expiry date.
  3. Choose renewal only after ruling out amendment, migration or fresh registration.
  4. Upload legible documents, pay only through the official gateway and save the acknowledgement.
  5. Track clarification requests until disposal.
  6. Download the certificate, verify every field and record the next due date.

Never hand an outside agent unrestricted portal or digital-signature access. Independently download the final certificate.

What to do if the certificate has already expired

Do not backdate a document or submit a false declaration. Capture the expiry, last certificate, filing history, current worker count, changes since issue and portal status.

Then check the state law for three possibilities:

Maharashtra Section 6(4), for example, expressly addresses an application made within 30 days after expiry. Rajasthan’s fee page specifies a penalty after 30 days from the renewal due date. Those are state-specific rules, not a national grace period.

Preserve proof that you filed, answered queries and paid. Tell any bank, client or tender authority the exact status; “under renewal” is misleading when no application exists.
